The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the presentation of a new 28-article proposal for ending the war appeared – briefly – to have been defused. A senior US official spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of contrasting events captured the bleak nature of the current period. By day, diplomatic battles are waged: positive announcements are delivered from various governments. Immense energy is expended on managing specific proposals. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "resolution".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is able to track rocket firings from Russian territory, a capability afforded by up-to-date information. From vantage locations, military aircraft that had been deployed to engage hostile guided weapons streaked across the sky – modern combat jets supplied to Ukraine by Western partners.

Moments later, Kyiv's missile defense thundered: multiple launches targeted at a incoming threat. This was a modern interception technology at work, presumably provided by allied countries. Every deployment creates sudden vibrations, shaking the windows. The instant of fear quickly gives way to sober acceptance: possibly the incoming missile won't cause damage this time, sparing the city from devastation and another blackout.

Continuous Dangers

Following this, a heavy machine gun engaged a unmanned aircraft close by, part of a defensive team – probably imported technology. Sadly, the bullets missed the hostile drone – it continued its flight toward its destination.

With pauses, this persisted until dawn. Kyiv greeted the early updates: several casualties, damage and utility failures in many homes as a result of the night's assault. As always, everyone still maintained normal activities – experiencing conflict. But those 24 hours illustrated Ukraine's vital need on Western support – a reliance that European nations are demonstrably unable to substitute in the short term.

Failed Diplomacy

The detailed framework from US administration provoked deep reactions, debate and profound anxiety – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new initiative from American administration follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, manages to fend off. They stabilise the situation but never actually secure success. This pattern will, certainly, continue.

Strategic Calculations

It is tempting to accuse certain parties of consistently pushing Russian terms. But that does not seem to be the entire situation. US administration operates on a principle familiar among seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The American government presumes that it is unfeasible to force Russia to abandon the areas that it already controls in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, American administration does minimal to deter Moscow, through diplomacy or military means, from thinking that the status quo will not evolve additionally in its advantage in the near future.

Opposing Positions

Therefore, the Kremlin is convinced that the clock favors them – that Ukraine and its allies are nearing depletion. Their incentive to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be many attempts to stop fighting, but they will persist as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, gradually sacrificing civilians and areas but averting a entire defensive failure until situations evolve in its advantage.

Current Realities

Realistically, there are no genuine requirements for a ceasefire. Now, subjective factors are becoming relevant: leadership ambitions to mediate resolution and secure international recognition, and Ukrainian leadership's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the flag against any initiative Kyiv finds unsuitable, so that their focus does not move to internal issues. And although their mission will now be much harder after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a only one week to kill the proposed articles of the latest plan. Aggressive and erratic handling of the matter by US administration, resistance by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, current information leaks, all did their job.

While new plans based on established approaches are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and reflect certain reluctance to alter the situation, if they maintain solidarity and enhance their military capacity at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, largely rely on sustained allied backing.
